This Privacy Policy applies to all users of the Website and Services, including visitors who browse the Website without creating an account, registered users who create an account and use our Services, clients who engage KulRakshak for paid services, nominees and family members added by users to the platform, and any other individuals whose data may be provided to us in connection with the Services.
For the purposes of the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025 (together, the "DPDP Law"), KulRakshak acts as a Data Fiduciary — the entity that determines the purpose and means of processing your Personal Data — and you are a Data Principal, the individual to whom the Personal Data relates. Where we process Personal Data solely on the instructions of another entity, we act as a Data Processor.
By accessing the Website or using our Services, you acknowledge that you have read, understood, and agree to the collection and use of your information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Website or our Services.

- Asset Recovery: Researching, identifying, and assisting in the recovery of unclaimed or forgotten assets on your behalf
- Communication: Sending service-related notifications, account alerts, renewal reminders, and responding to your inquiries and support requests

Under the DPDP Law, our processing rests primarily on your consent, together with certain legitimate uses expressly permitted by the Act:

- Legitimate Uses (as permitted by the DPDP Act): Processing for certain specified uses that the Act permits without separate consent — for example, a purpose for which you have voluntarily provided your Personal Data and have not indicated an objection, responding to a medical emergency or threat to life or health, and complying with a legal or regulatory obligation.
- Contractual Necessity: Processing necessary to perform a contract to which you are a party, or to take steps at your request before entering into a contract (for example, providing the Services you have engaged us for).
- Legal Obligation: Processing necessary for compliance with a legal obligation to which KulRakshak is subject, including regulatory requirements, tax obligations, and orders of courts or authorities.
Consent Managers: Once this facility becomes operational under the DPDP Rules, 2025, you will be able to give, manage, review, or withdraw your consent through a Consent Manager registered with the Data Protection Board of India. We will build and maintain the functionality necessary to interoperate with registered Consent Managers.
6) How We Share Your Information
KulRakshak does not sell, trade, or rent your Personal Data to third parties for marketing or commercial purposes. We may share your information only in the following limited circumstances:
Authorized Sharing
- With Your Consent: When you have given explicit permission to share specific information with a designated third party
- Nominees & Family Members: Sharing information with nominees or authorized family members as configured by you in the platform's access settings
- Professional Advisors: Sharing with your legal, financial, or tax advisors upon your instruction and with your consent

We conduct due diligence on our service providers to ensure they maintain appropriate data protection standards.

The security of your Personal Data is of paramount importance to KulRakshak. 8) Data Retention
KulRakshak retains your Personal Data only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, regulatory, accounting, or reporting requirements. In line with the DPDP Law, we will erase your Personal Data once the purpose for which it was collected is no longer being served and retention is no longer required by law — for instance, where you withdraw consent, the purpose is fulfilled, or you have not engaged with the Services within the applicable retention period. Our retention practices are guided by the following principles:

- Active Account Data: Retained for as long as your account is active and you continue to use our Services
- Digital Vault Data: Retained for as long as your account is active. Upon account termination, you will have an opportunity to export your data before permanent deletion
- Service Records: Retained for a period of seven (7) years from the date of completion of the relevant Service, in accordance with Indian regulatory and tax requirements
- Financial Transaction Records: Retained for a period of eight (8) years from the date of the transaction, in compliance with applicable financial regulations
- Communication Records: Retained for a period of three (3) years from the date of the last communication
- Marketing Preferences: Retained until you withdraw consent or opt out of marketing communications
- Website Usage Data: Aggregated and anonymized usage data may be retained indefinitely for analytical purposes
- Legal Hold: Data that is subject to a legal hold, litigation, or regulatory investigation will be retained until the matter is resolved, regardless of normal retention periods

- Right to Correction & Completion: You have the right to request correction, completion, or updating of any inaccurate, incomplete, or outdated Personal Data. You can update most information directly through your account settings
- Right to Erasure: You have the right to request deletion of your Personal Data, subject to legal retention obligations and legitimate business needs. Upon receiving a valid deletion request, we will erase your data unless retention is required by law
- Right to Withdraw Consent: Where processing is based on your consent, you may withdraw consent at any time, as easily as you gave it. Withdrawal of consent will not affect the lawfulness of processing carried out prior to withdrawal

11) Digital Vault — Privacy Specifics
The Secure Digital Vault is a core feature of KulRakshak and handles some of the most sensitive information entrusted to us. The following additional privacy commitments apply specifically to data stored in the Digital Vault:
🔒 Digital Vault Privacy Commitments:
- Your Data, Your Control: Documents and records stored in the Digital Vault are your property. KulRakshak serves as a custodian and does not claim any ownership, license, or rights over your stored content
- Zero-Knowledge Access: KulRakshak personnel do not access the contents of your Digital Vault unless explicitly authorized by you for service delivery purposes (e.g., claim assistance, document preparation)
- Encryption at Rest: All documents stored in the Digital Vault are encrypted at rest using AES-256 encryption standards
- Access Logging: Every access to your Digital Vault is logged and auditable, including the identity of the accessor, timestamp, and actions performed
- Nominee Privacy: When you designate nominees and configure access permissions, the nominee will only be able to view the specific documents or categories you have authorized — not your entire vault
- Export & Deletion: You may export all data from your Digital Vault at any time. Upon account deletion, all vault data will be permanently and irrecoverably destroyed within sixty (60) days, unless retention is required by law
12) Children's Privacy
KulRakshak's Website and Services are not directed at individuals under the age of 18 years. We do not knowingly collect, solicit, or process Personal Data of a child (a person below 18 years of age) without the verifiable consent of the child's parent or lawful guardian.
In accordance with the Digital Personal Data Protection Act, 2023, we do not undertake any tracking, behavioural monitoring, or targeted advertising directed at children, and we will not process a child's Personal Data in a manner that is likely to cause a detrimental effect on the well-being of the child. Where processing of a child's Personal Data is necessary, we will obtain and maintain verifiable consent from the child's parent or lawful guardian before doing so.
If we become aware that we have inadvertently collected Personal Data from a child without verifiable parental consent, we will take prompt steps to delete such information from our records. If you are a parent or guardian and believe your child has provided us with Personal Data, please contact us immediately at info@kulrakshak.com.
In cases where a user stores information about their minor children (e.g., identity documents, medical records) in the Digital Vault as part of family documentation, such storage is undertaken by the user, in their capacity as parent or lawful guardian, and at the user's discretion and responsibility. The same security and privacy protections apply to all data stored in the Digital Vault regardless of the data subject's age.
13) Data Transfers
KulRakshak primarily stores and processes your Personal Data on servers located within India. We are committed to complying with applicable data localization requirements under Indian law.
In certain limited circumstances, your data may be accessed from or transferred to locations outside India — for example, if we use international cloud service providers for hosting or backup, or if we engage service providers located outside India for specific operational functions. Any such transfer will comply with the DPDP Law and any restrictions the Central Government may notify on transfers to particular countries or territories.
In such cases, we ensure that:
- The transfer is carried out in compliance with applicable Indian data protection laws and regulations, including any sector-specific localization requirements
- The receiving party provides an adequate level of data protection that meets the standards required under Indian law
- Appropriate contractual safeguards are in place, including data processing agreements with strong confidentiality and security clauses
- Data transfers are limited to what is strictly necessary and are conducted using encrypted channels
- We retain responsibility and accountability for your data regardless of where it is processed
We will notify you if a material change occurs in our data transfer practices and, where required, seek your consent before transferring your data to a new jurisdiction.

16) Data Breach Notification
KulRakshak takes data breaches seriously and has established a comprehensive incident response framework. In the event of a personal data breach involving your Personal Data, we will:

- Detect & Contain: Immediately investigate and take steps to contain the breach, prevent further unauthorized access, and minimize potential harm
- Assess: Evaluate the scope, severity, and potential impact of the breach, including identifying the categories of data affected and the number of individuals impacted
- Notify the Data Protection Board: In accordance with the Digital Personal Data Protection Act, 2023 and the DPDP Rules, 2025, we will notify the Data Protection Board of India, without delay upon becoming aware of the breach, of its nature, extent, timing, and likely impact; and we will furnish the Board with a detailed report — covering the events and circumstances that led to the breach, the measures taken to mitigate risk, and remedial actions to prevent recurrence — within 72 hours of becoming aware (or such longer period as the Board may allow on request)
- Notify CERT-In: Where applicable, we will also report the incident to the Indian Computer Emergency Response Team (CERT-In) and any other relevant regulatory authority within the timeframes prescribed under applicable law
- Notify Affected Individuals: We will inform each affected Data Principal, without unreasonable delay and through their registered mode of communication, in clear and plain language. The notification will describe the nature and extent of the breach, the Personal Data affected, the likely consequences, the measures we have implemented or propose to implement to mitigate risk, safeguards you can take to protect your interests, and a contact point for any queries
- Remediate: Implement corrective measures to address the root cause of the breach and prevent recurrence, including updating security protocols, conducting additional audits, and enhancing monitoring systems
- Document: Maintain a complete record of the breach, our response, and the outcomes for regulatory compliance and continuous improvement
